Shuster & Saben beats United Automobile Insurance Company in trial

Shuster & Saben recently got final judgment on a three-day jury trial where partner Adam Saben and associate Marisol Estevez represented a small, family-owned clinic in Miami that treated a gentleman injured in a motor vehicle accident in 2008. The patient was insured with United Automobile Insurance Company, who was the Defendant in the case. United Automobile denied all benefits after sending their insured for an examination by an "independent" doctor selected by a third-party vendor. United's doctor said that no more treatment was medically necessary and that report was obtained during the course of treatment with our client in 2008. However, on the eve of trial, three YEARS later, United Automobile went out and got another report from the same "independent" doctor finding that treatment rendered before the insurance company's medical examination was also not now medically necessary. Interestingly, partner Adam Saben brought out on cross-examination that this same "independent" doctor conducted approximately 1500 of these insurance examinations and "peer reviews" over the last three years (and thousands more over the last twenty years), and the doctor's findings were in favor of the insurance company over 95% of the time.
Fortunately, the six-member Miami-Dade County jury weighed the credibility of the medical evidence and returned a verdict in favor of our client, awarding our client $4,473.00, which was almost the entire bill in full. The redacted jury verdict form is below:
